Acceptance of Terms

By accessing, browsing, or using Passport Photo Tools (the "Service"), available at passportphototools.com and its associated domains createpassportimage.com and passportphotoshop.com, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must discontinue use of the Service immediately. We reserve the right to modify these Terms at any time, and your continued use of the Service following any changes constitutes acceptance of the modified Terms.

Description of Service

Passport Photo Tools is a free, browser-based application that assists users in creating compliant passport, visa, and identification document photos for over 195 countries. The Service provides country-specific photo templates, AI-powered face detection and positioning, automated background replacement, image cropping and resizing tools, and comprehensive guides on photo requirements. All image processing is performed entirely within your web browser using client-side technologies. No images are uploaded to or stored on our servers.

Eligibility

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the Service. If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian. By using the Service, you represent and warrant that you meet these eligibility requirements.

Acceptable Use

You agree to use Passport Photo Tools only for lawful purposes and in compliance with all applicable local, national, and international laws and regulations. Specifically, you agree to:

  • Use the Service solely for creating legitimate identification document photographs for personal, family, or authorized professional purposes
  • Ensure that photos you create comply with the official requirements of the target country or issuing authority
  • Not use the Service to create fraudulent, forged, or counterfeit identity documents
  • Not attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of any proprietary component of the Service
  • Not interfere with, disrupt, or place an unreasonable burden on the Service's infrastructure, servers, or networks
  • Not use automated scripts, bots, or crawlers to access the Service in a manner that exceeds reasonable human usage
  • Not attempt to circumvent, disable, or interfere with any security features or access restrictions of the Service
  • Not use the Service for any activity that violates the rights of others, including privacy and intellectual property rights

User Content and Intellectual Property

Your Content

You retain full ownership of all images and photos you process through the Service. We claim no ownership, license, or rights to any images you upload or create. Because all image processing occurs locally in your browser, we never have access to, possession of, or control over your photos.

Our Content

The Passport Photo Tools software, website design, user interface, documentation, guides, articles, country data, graphics, logos, and all associated intellectual property are owned by us or our licensors and are protected by international copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose. This license does not permit you to:

  • Copy, modify, or distribute any part of the Service's software or content without prior written permission
  • Use our trademarks, logos, or branding in any manner that implies endorsement or affiliation without authorization
  • Reproduce or republish our guides, articles, or country-specific data on other websites or publications without attribution and permission

Open Source Components

Certain components of the Service may utilize open-source libraries and frameworks, each governed by their respective open-source licenses. These licenses are available in the project repository and take precedence over these Terms with respect to those specific components.

Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

Without limiting the foregoing, we do not warrant or guarantee that:

  • Photos created using the Service will be accepted by any government agency, embassy, consulate, or other issuing authority
  • The country-specific templates, dimensions, and requirements displayed in the Service are current, complete, or error-free at all times
  • The Service will be available without interruption, error, or delay
  • The AI-powered features (face detection, background replacement) will produce perfectly accurate results in every case
  • The Service will be compatible with all devices, browsers, or operating systems

You are solely responsible for verifying that your final photo meets all official requirements of the issuing authority before submitting it with your application. Government photo standards change periodically, and while we strive to keep our presets updated, we cannot guarantee real-time accuracy for every country.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PASSPORT PHOTO TOOLS, ITS OWNERS, OPERATORS, AFFILIATES, OR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE. This includes, without limitation, damages for:

  • Rejected passport, visa, or identification document applications
  • Delays in processing applications due to non-compliant photos
  • Lost time, travel costs, or appointment fees resulting from photo rejection
  • Loss of data or unauthorized access to your device
  • Any other losses or damages of any kind

Our total aggregate liability for any claims arising from the Service shall not exceed the amount you have paid us for use of the Service (which is zero, as the Service is provided free of charge).

Indemnification

You agree to indemnify, defend, and hold harmless Passport Photo Tools, its owners, operators, affiliates, and contributors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

Third-Party Services and Advertising

The Service displays advertisements through Google AdSense and uses Google Analytics for website analytics. These third-party services operate under their own terms of service and privacy policies. Your interaction with any advertisement or third-party service linked from our website is solely between you and that third party. We are not responsible for the content, accuracy, or practices of any third-party website, service, or advertisement.

The inclusion of advertisements does not constitute endorsement of the advertised products or services. We have no control over and assume no responsibility for the content or conduct of third-party advertisers.

Service Modifications and Availability

We reserve the right to modify, update, suspend, or discontinue any aspect of the Service at any time, with or without notice, for any reason. This includes adding or removing features, changing the user interface, updating country templates, or temporarily taking the Service offline for maintenance. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable international law and the laws of the jurisdiction in which the Service is operated, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation between the parties. If negotiation fails, the dispute shall be resolved through binding arbitration in accordance with the rules of a mutually agreed-upon arbitration body.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.

Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and Passport Photo Tools regarding your use of the Service. These Terms supersede all prior agreements, communications, and understandings, whether written or oral, relating to the subject matter herein.
